The Law: Multiple ESAs Are Possible Under the FHA
The Fair Housing Act does not specify a maximum number of emotional support animals a tenant may have. HUD guidance makes clear that each accommodation request must be evaluated on its individual merits — which means a tenant with two separate ESAs can submit two separate accommodation requests, and a landlord must evaluate each one on its own basis. That said, the more animals requested, the more scrutiny a landlord is legally permitted to apply. A request for five ESAs in a studio apartment, for example, could plausibly be denied if the landlord can document that the accommodation would create genuine undue hardship or substantial property damage risks. Two ESAs in a standard apartment — by far the most common multiple-ESA situation — is generally evaluated much more favorably.
What Documentation You Need for Each Additional ESA
For a multiple-ESA accommodation request, each animal should be documented individually in your ESA letter or in separate letters. Your licensed mental health professional must be able to articulate: why each specific animal is therapeutically necessary (not just why animals in general are beneficial); how each animal addresses distinct aspects of your qualifying disability; or why having this specific combination of animals together is necessary for your treatment. Generic letters that say 'this tenant needs two dogs for emotional support' without specifying why two separate animals are individually necessary are more likely to be challenged by landlords. Letters that explain 'Animal A provides grounding during dissociation episodes while Animal B provides nighttime support during PTSD-related sleep disruption' are far more defensible.
How Landlords Can Respond to Multiple ESA Requests
Landlords receiving multiple ESA accommodation requests can: request documentation for each animal separately; ask clarifying questions about why multiple animals are each individually necessary; evaluate whether the total number of animals in the unit creates a direct threat or undue hardship (this evaluation must be specific and documented, not based on assumptions); and in rare cases deny accommodation for additional animals beyond what is documented as necessary, if they can demonstrate specific, documented hardship. What landlords cannot do: automatically deny all requests for more than one ESA without individual evaluation; apply a blanket 'one ESA per unit' policy as if it were law (it is not); or charge per-animal fees for ESAs even if multiple animals are approved.
